Court Ruling Grants Wells Fargo Claim and Delivery Order Against Dugan Sales and Service
Wells Fargo Commercial Distribution Finance, LLC (Wells Fargo) has recently secured a court ruling in their favor against Dugan Sales and Service, granting them an order for claim and delivery. The decision was made by the Honorable Robert L. Spears at the Codington Courthouse on July 22, 2024, based on an affidavit supporting the claim and delivery under SDCL § 21-15-1.
Wells Fargo filed a Summons and Complaint for Claim and Delivery on July 11, 2024, seeking immediate possession of the collateral securing debt owed by the Defendant. The Defendant had failed to make a scheduled payment of $576,412.87, and Wells Fargo estimates the value of the inventory to be $1,326,009.71.
According to court documents, the court has ordered that Wells Fargo is entitled to immediate possession of the collateral, including the inventory, which is permanently assigned to them. The Defendant must promptly deliver the inventory to Wells Fargo, who is authorized to sell, transfer, or dispose of it to recoup funds.
